For decades, cannabis has been stuck in Schedule I — a classification that no longer matches medical use, state-level legalization, or the existence of a federally legal hemp industry. Now, the federal government is trying to modernize policy without fully ending prohibition, and that shift is creating real risks for hemp.

Hemp was legalized under the 2018 Farm Bill, but unclear federal language and ongoing agency reviews have left the industry vulnerable. As marijuana rescheduling moves forward, overlapping cannabinoids like CBD and delta-9 THC could be pulled into more restrictive frameworks unless hemp is clearly protected.

Between now and November, lawmakers and regulators are actively reviewing cannabis and hemp policy. This window will determine whether hemp remains:
✔️ legally distinct
✔️ accessible to consumers
✔️ responsibly regulated
—or whether large parts of the industry are restricted or wiped out entirely.
