Welcome to Season 2 of Plaintiff Prep. In this season, our personal injury lawyers in Orlando Florida will be talking all about depositions. The purpose of this video is to help you understand what a deposition is so you can be more prepared when this part of your Orlando personal injury case comes around.

WHAT IS A DEPOSITION?

A deposition is a legal procedure that occurs during the discovery phase of the lawsuit where the attorneys call the parties to the lawsuit, as well as any witnesses, to appear and be questioned under oath in the presence of an official court reporter. Each party or witness is sworn to tell the truth and then separately questioned about the case.

Depositions are typically held at the office of your attorney or the defendant’s attorney. If you are concerned about where the depositions are set to take place, speak to your attorney. Your attorney may be able to change the location of the depositions.

Don’t worry, your attorney will be there with you throughout the deposition, and the other party or witnesses will not be in the room. Typically, the attendees at your deposition will be you, your attorney, opposing counsel, the court reporter, and maybe a videographer, depending on the circumstance.

When the depositions are finished, the court reporter will make a transcript of your testimony. Then, you will be permitted to review the transcript and sign it. After that, the transcript of your deposition may be used at trial to cross examine you if you change your story somewhere along the way.

The deposition could last a couple of hours, all day, or it may be carried over to the next day or some other time. Scheduling of a deposition can be worked around each party’s availability, but parties are expected to make an effort to be flexible.

If you’re concerned about your upcoming deposition, contact your attorney. That way, your attorney can work with you to review the questions that will most likely be asked and the subjects that will be covered. Your attorney can also help you think through appropriate answers to difficult questions that may be hard for you to answer or catch you off guard. Your attorney can also help you to avoid legal and factual pitfalls during the deposition, as well as any “Gotcha” techniques the defense may try to employ.
