The constitutional implications of a leadership directive associated with Fine Gael

The current design of Ireland’s Protected Disclosures (whistleblowing) regime, as amended

Whether that regime complies with the EU Whistleblower Directive

A wider, deeply concerning pattern in which genuine constitutional cases are increasingly reclassified as “political” or “personal grievances”, preventing proper constitutional scrutiny

Through examining multiple cases — both in Ireland and internationally — I have identified patterns suggesting that constitutional issues of real public importance can be quietly filtered out through procedural recharacterisation rather than addressed on their merits.

This case is not about personal grievance. It is about ensuring that:

Constitutional questions are heard as constitutional questions

The separation of powers is respected

EU law obligations are meaningfully upheld

Courts remain accessible for serious public-interest challenges

Ireland now has an opportunity to lead by example, to reaffirm constitutional oversight, and to send a powerful message — nationally and internationally — that democratic safeguards still matter.
