வாய்மொழி பாகப்பிரிவினையை தெளிவாக ஆதாரங்களோடு நிரூபிக்க வேண்டும். வாதி தாக்கல் செய்திருக்கும் ஆவணங்கள் ஏற்கனேவே வாய்மொழியாக பாகப்பிரிவினை நடந்ததை நிரூபிக்க வேண்டும். வழக்கு தாக்கல் செய்யும் சமயத்தில் வழக்கு சொத்து வாதிகள் பெயரிலோ அவரது முன்னோர்கள் பெயரிலோ இல்லை என்றால் வாய்மொழி பாகப்பிரிவினை ஏற்பட்டது என்று கூறுவதை ஏற்க முடியாது என்று இந்த தீர்ப்பில் கூறப்பட்டுள்ளது.
