WILL MY PENALTIES BE STEEPER FOR USING A DEADLY WEAPON IN CARRYING OUT A CRIME?
Yes. NRS 193.165 is an enhancement for use of a deadly weapon during commission of a felony in Nevada. It provides an additional penalty of up to 20 years to the underlying felony penalty. The enhancement runs consecutively with the underlying felony penalty, though the length of the enhancement can be no more than the length of the underlying felony penalty. Furthermore, people convicted of using a deadly weapon cannot be granted probation in Nevada.
When determining the length of the deadly weapon enhancement, a Nevada judge can consider the following circumstances.
-circumstances of the underlying crime
-the defendant's criminal history
-the impact that the deadly weapon had on the victim
-any other mitigating factors in the case
