Section 6A OF Citizenship Act, 1955

Section 6A of the Citizenship Act, 1955, was introduced as part of the Assam Accord, signed in 1985, to address issues arising from the influx of illegal immigrants into Assam. This section provides special provisions for citizenship concerning Assam, distinguishing it from the rest of India due to its unique historical and demographic circumstances.

According to Section 6A, individuals who entered Assam from Bangladesh before January 1, 1966, and have been residing there since, are granted Indian citizenship. Those who entered Assam between January 1, 1966, and March 24, 1971, would have to register themselves with the Foreigners Tribunal and remain as foreigners for 10 years. After this period, they would be eligible to register as Indian citizens, provided they continued residing in Assam.

The provision aimed to strike a balance between addressing the concerns of indigenous populations regarding demographic changes and offering a solution to long-term residents. However, Section 6A has been a subject of controversy, with debates on its constitutionality and impact on Assam's demographic fabric, leading to petitions being filed in the Supreme Court for its review. The section remains a significant point of discussion in the broader context of citizenship, identity, and migration issues in Assam.
