The Electoral Court has furnished reasons behind its order that paved the way for former President Jacob Zuma to remain on the newly-formed MK political party candidate list. The judgment, delivered on Friday by the five-member panel had three opinions that ultimately led to the Specialist Court concluding that the appeal should succeed. The former President challenged his disqualification based on Section 47(1)(e) of the Constitution which bars anyone convicted of a crime and sentenced to 12 months or more imprisonment from being a member of the National Assembly. The disqualification stands for another five years after the sentence is completed. Zuma was sentenced to 15 months for contempt in the Constitutional Court, the fact that he could not appeal formed part of the court's reasoning that the said section did not apply to him.
