This video is made for CLAT PG 2024 exam preparation. This video is a must watch CLAT PG Preparation. The Supreme Court recently issued a judgment on a batch of petitions challenging the 2016 decision of the Indian government to demonetize Rs. 500 and Rs. 1000 currency notes. The main argument raised by the petitioners was that the government could only demonetize certain specified series of currency notes and not all series, as per Section 26(2) of the Reserve Bank of India Act 1934. The majority opinion, however, held that a purposive and pragmatic interpretation of the provision must be adopted and that the word "any" in the provision should be interpreted as "all." The Court also observed that the procedure prescribed in the Act was followed and that there was a consultative process between the Central Board of the Reserve Bank of India and the government before the decision to demonetize was taken. The majority also held that the Reserve Bank of India does not possess independent power to accept the demonetized notes beyond the period specified in notifications issued by the government under the Specified Bank Notes (Cessation of Liabilities) Act 2017. This judgment will be of interest to law students preparing for the CLAT PG exam in 2024.
