Hello Everyone! The Delhi High Court has rejected Rajpal Naurang Yadav's final plea to avoid imprisonment related to cheque dishonour cases. The Court has mandated that he must surrender to jail authorities before any further hearings can take place. This decision follows Yadav's failure to meet a surrender deadline set by the Court, which was a result of his repeated violations of agreements to settle payments owed to the complainant company.
During the proceedings, Yadav's senior lawyer indicated that the actor was prepared to deposit Rs 25 lakh immediately and that a repayment schedule for the remaining dues had been tentatively agreed upon by both parties. However, the Court denied any relief, noting that Yadav had already been ordered to surrender by February 4, 2026. Justice Sharma emphasized that Yadav would only be heard after he presents himself to the jail authorities.
Yadav's counsel informed the bench that the actor would surrender at Tihar Jail later that day. The Court clarified that after his surrender, Yadav would have the opportunity to file an appropriate application according to the law.
Previously, the High Court had withdrawn leniency towards Yadav and instructed him to surrender to the Jail Superintendent by February 4, 2026, at 4 PM, due to his repeated violations of settlement agreements. The trial court had suspended the sentence in June 2024 to allow for a settlement between the involved parties, but the Court noted that this relief was granted based on assurances that payments would be made.
The Court recorded that Yadav had failed to honor commitments made in judicial orders, with multiple timelines set for payments, which he did not meet. The Court also pointed out that partial payments promised were not made within the required timeframe. It rejected explanations regarding technical errors in demand drafts, stating that such reasons did not inspire confidence given the ongoing pattern of defaults.
Justice Swarna Kanta Sharma remarked on the serious nature of the breaches and the admitted liabilities, ultimately deciding against extending further indulgence.
