In this video I talk about the case Mkhonto v Global Elite Protection and another (2024), where a security officer was dismissed for allegedly consuming alcohol without being given a hearing or a breathalyser test. The Commissioner determined that the dismissal was found to be substantively and procedurally unfair because the officer was not given a chance to defend himself, and no proof of alcohol consumption was presented. The applicant was reinstated with six months’ back pay.
