The Story: The landlord wants me out by January 20th. She refuses to return my January rent, which I paid in full, and she’s demanding I keep paying until she finds a new tenant. This is all happening in Texas.

I moved into this house back in July. I signed a standard lease ending on December 31st. A while ago, I asked if I could stay through the spring semester, and she agreed via text to modify the end date to July 31st. The problem is, the living situation has become unbearable with her daughter, and I’ve found a new place for less than half the price. We both agreed it was best that I leave.

Here is the catch: I never actually signed a new physical lease. She never sent me an updated document to sign, not by email and not in person. We only discussed the extension over text. On the original lease I signed, it explicitly states that if I stay past December 31st, the agreement automatically converts to a month-to-month tenancy.

Is she actually legally allowed to force me out mid-month and keep my deposit based on a text message? How is this behavior acceptable?
