In this LESSON 5 we commenced revision of tort of Negligence.
Negligence as a tort is established by proving three elements: (a) duty of care (b) breach of duty of care and (c ) Consequent or Resultant Damage or Injury or Loss. In this lesson we briefly discussed duty of care.
We made point that for purposes of examinations especially for problem type question, examiners may be testing one or two elements in the problem but you must still outline the three elements in your introduction before you will focus more on principles of the relevant element being tested mainly. The factual scenario will make it obvious to you which particular element is being tested. You must also ask yourself whether you have enough information in the story provided in the question to address any of the three elements in detail.
