On January 27th, 2024, at approximately 4:26 PM, an Officer Specialist with the Florida Fish and Wildlife Conservation Commission was on marked water patrol during the Gasparilla flotilla vessel parade. A white cabin vessel was observed displaying a registration sticker but lacked visible registration numbers on the port side. The vessel also had a sex doll on one of two flagpoles alongside two pirate flags.
A vessel stop was initiated using emergency lights. The operator, a white male, began to yield but failed to maneuver properly, causing the vessel to drift. Faint registration numbers were visible but did not meet legal requirements under FSS 328.48 (4).
The officer informed the operator of the stop’s reason. The operator, appearing slow and lacking dexterity, retrieved identification and vessel registration. He had dry lips, a strong odor of alcohol, bloodshot eyes, and slurred speech. He leaned on the vessel for support and had difficulty securing a personal flotation device.
During a vessel safety inspection, a trash bag filled with empty alcohol containers was observed. The operator lacked a serviceable fire extinguisher and a Type IV throwable device, as required by FSS 327.50. He admitted to consuming two drinks on board.
Based on observed impairment, the operator was arrested for FSS 327.35 – boating under the influence. After being read Miranda rights, he agreed to speak. At the HCSO Marine Substation, he admitted to taking the prescription drug Meloxicam but gave conflicting statements about its last use.
A breath test returned a 0.00 BAC, inconsistent with observed impairment. A Drug Recognition Expert conducted further evaluation, and the operator consented but failed to provide a urine sample despite multiple attempts, stating, “Hit me for refusal, I don’t have to f***ing pee.” A Notice of Civil Penalty was issued for refusal.
The operator was transported to Hillsborough County Jail for boating under the influence and cited for improper vessel registration and refusal to submit to a chemical test. Written warnings were issued for lacking required safety equipment.
