If you think the sale of your property after foreclosure is legitimate, think again. A special master should only be used in "complicated matters" and should be the exception, not the rule. Use of a special master is at the discretion of the judge so if he decides to appoint one, you really cannot question it. But what is really happening at this sale?

Listen here. The special master doesn't do anything but show up to the courthouse steps and reads a document. He doesn't draft or even review the documents on which he places his name. He doesn't verify whether the information is accurate. He doesn't even draft the deed. Who does all this? The "client", which is the plaintiff's attorney. What does it mean? It means the plaintiff is taking possession of title to your property and transferring it to itself! The use of the "Courts" is smoke and mirrors. Judges rubber stamp everything that is placed in front of them by the plaintiff/attorney.

Are you starting to see the scam?? Based on our research, no foreclosure of a "securitized" loan is legitimate and there is no lawful way to dispossess you of property within a foreclosure action. A foreclosure judgment is intended to ascertain lien priority (Romero v. State, 1982-NMSC-028). A "sale" results in a deed, which may or may not be superior to claims by others. Writs of assistance under the forcible entry and unlawful detainer statute falls under the magistrate court (limited) jurisdiction, does not litigate title, and applies to controversies less than $10K. An [owner] cannot be dispossessed of property via a summary proceeding (Ott. v. Keller). A writ of possession issued by district courts under Rule 1-065 applies to ejectment actions under NMSA 1978 42-4-12. Ejectment actions require a jury trial.
