On November 7, 2024, an officer with the Florida Fish and Wildlife Conservation Commission (FWC) was on land patrol in a marked vehicle in Broward County. While patrolling the L5 levee in the Holey Land Wildlife Management Area (WMA), the officer observed five individuals fishing with rod and reels in hand. Emergency lights were activated, and the individuals were stopped for trespassing.
Upon approaching the individuals, they were identified and found to have passed multiple closed area signs to reach their location in the WMA. Holey Land WMA was currently closed due to a high-water closure.
While speaking with the individuals, the officer noticed empty casings of handgun and rifle ammunition on the ground. When asked if they had been shooting off the levee, they confirmed they had. The officer inquired about the location of the firearms, and one of the individuals stated that they were in the front seat of their vehicle. Upon opening the passenger-side door, the officer observed an AR-15. When asked about a pistol, the same individual assisted in locating it underneath the passenger seat. Both firearms were secured in the front seat of the patrol vehicle for the remainder of the stop.
Another officer arrived at the scene to assist. The assisting officer ran the serial numbers of the firearms through dispatch to determine if they were reported missing or stolen. The handgun, a Glock 43x, returned as stolen. The assisting officer then conducted an interview with the firearm’s owner after reading the individual their Miranda rights. The individual agreed to speak and stated that the firearm had been purchased at a gun show for $250 from an unidentified Hispanic male. The officer informed the individual that the firearm would be seized due to its stolen status, and the individual completed a witness statement regarding its acquisition.
All five individuals were issued a criminal citation for violating administrative code 68A-15.004(14) by entering an area posted as closed to public access in a WMA. Additionally, they were each cited for fishing without a freshwater fishing license. All individuals signed and accepted their citations without further incident.
