RESIDUARIES
Residuaries take what’s left after the shares if any.
A. DESCENDANTS
1. Son
 When there is son, daughter is also a residuary. Son takes a double portion.
2. Son’s son how lowsoever
 Nearer excludes the remoter.
B. ASCENDANTS
3. Father
4. True grandfather
 Nearer excludes the remoter
C. DESCENDANTS OF FATHER/COLLATERALS
5. Full brothers
 Full sister takes as residuary
6. Full Sisters
 If residuary 1 to 5 are not there, she takes as residuary.
7. Consanguine brothers
 Consanguine sister will take as residuary.
8. Consanguine sisters
 If residuary 1 to 7 are not there, she takes as residuary.
9. Full brother’s son
10. Consanguine brother’s son
11. Full brother’s son’s son
12. Consanguine brother’s son’s son
D. DESCENDENTS OF TRUE GRANDFATHER, HOW LOWSOEVER
13. Full paternal uncle
14. Consanguine paternal uncle
15. Full paternal uncle’s son
16. Consanguine paternal uncle’s son
17. Full paternal uncle’s son’s son
18. Consanguine paternal uncle’s son’s son
19. Male descendants of remote true grandfather




DISTANT KINDERED
They are those who are neither sharers nor residuaries.
A. DESCENDANTS
1. Children of daughters and their descendants
2. Children of son’s daughters and their descendants
B. ASCENDANTS
1. False grandfather how high soever
2. False grandmother how high soever
 Nearer excludes the remoter
C. DESCENDANTS OF PARENTS
1. Brother’s daughters and their descendants
2. Brother’s son’s daughters and their descendants
3. Sister’s children and their descendants
D. DESCENDENTS OF IMMEDIATE GRAND-PARENTS
 Remote ancestors

ORDER OF SUCCESSION
1. Only sharers
2. Only residuaries
3. Only distant kindered
4. Only Successor by contract
5. Only acknowledged kinsman
6. Only universal legatee
7. Only government
