The Empire State Development Corporation (ESDC) used eminent domain to acquire commercial properties in West Harlem for the development of a new Columbia University campus. The Project includes 16 new buildings, adaptive reuse of an existing building, and creation of publicly accessible open space. Business groups requested documents related to the Project under the Freedom of Information Law (FOIL), but ESDC failed to provide a specific reason for denying disclosure of documents related to its agreement with Columbia. The court had to analyze the constitutionality of the project and whether it qualifies as a "land use improvement project" and a "civic project" under the UDC Act.
