We're with John Kelly. John is a personal injury attorney in Phoenix and he's agreed to answer questions related to "What is statute of limitations?" and this question in particular, has a specific question. This question's from Renee. Renee says, "My co-worker tried to file a suit for a medical claim. She has a legitimate claim to make but she was told that the statute of limitations has expired and she couldn't do anything." Can you really run out of time?

Ah, yes, for Renee, her co-worker could have run out of time to bring a claim. The statute of limitations is an actual statute. Each state has different types of statute's for different types of claims. You have to make sure that you know what your statute of limitations is. It's the amount of time that you have to bring a claim before it becomes barred forever, legally. There's, in Arizona, typically, with a negligence claim we have two years. There's circumstances that it's one year. And there's times that it's actually told longer. And those are usually for situations where we have a minor, say, that's injured. The time that they have to bring a claim is actually two years after they turn 18. So that's a totaling of the statute of limitations. Now with Renee's coworker, she was told that the time limit's have run up. It is possible that she still can bring a claim. There's a lot of case law that attorney's can review and see if the circumstances fit. But you can always file a motion to try to bring a claim after the statute of limitations has run. Sometimes those arguments are there and sometimes they're not there. So you wanna make sure that any time you have a claim, you wanna make sure you reach out to an attorney. Get them working on the case early, in making sure they're bringing a lawsuit within that time period that's allowed, within the law.
