Why India Doesn’t Support Sex Selection
India has a long-standing cultural bias toward male children. This mindset led to a sharp drop in female birth rates, creating a dangerous gender imbalance. To correct this, the PCPNDT Act was introduced in the late 1990s. It strictly prohibits any form of sex selection—before or after conception.
Legal Consequences: Not Just for Doctors, But for Patients Too

Dr. Bhatt clarifies:
Doctors involved in sex selection face 3 years of imprisonment.
Patients requesting sex selection also face 3 years in jail and ₹50,000 fine under Section 23(3) of the PCPNDT Act.
Ignorance of the law is not a defense. Just asking makes you legally liable.

ART Act Raises the Stakes
When sex selection is attempted via IVF or ART procedures, the ART Act steps in. The punishment rises to 8 years of imprisonment. Patients become answerable under both the PCPNDT and ART Acts.

Do Not Ask for Sex Selection
Dr. Bhatt urges everyone to stop seeking male or female child preferences. A girl and a boy have equal legal and moral value. India’s legal framework protects this equality, and the law is clear: even asking is a crime.

What Genetic Testing is Allowed?
Genetic testing can be performed in specific medical situations:
Advanced maternal age
Family history of genetic disease
Donor egg/sperm cases
Confirming embryo chromosomal health (aneuploidy screening)

However, genetic testing cannot be used for sex selection. Certified labs will not reveal sex chromosomes unless a sex-linked disorder is medically proven.

How Many Embryos Can Be Transferred?
Dr. Bhatt explains the legal limits:
Prefer one embryo per transfer
Two embryos only when there’s a valid indication
Three embryos max, and only with strong justification

Doctors must inform couples and respect their decision. If the couple wants only one child, no additional embryos can be transferred—even if natural twinning happens later.

Foreign Nationals and ART in India
While surrogacy is banned for foreign nationals, they can still access ART procedures like IVF and IUI. However, they must comply with Indian laws regarding genetic testing, embryo transfer limits, and documentation.

Dr. Bhatt’s Final Word
Legal awareness is the first step toward ethical reproductive care. Patients must never request sex selection, and doctors must stay informed about the evolving legal framework in India.
