Technically, no, we don't have an "inspection period" in our state purchase contracts. Instead, we've got an "option period".

The 1-4 Family Residential Contrat (Resale) is the standard contract, promulgated by the Texas Real Estate Commission, used for residential sales in Texas. This is the contract we use, as real estate agents, when we help our clients purchase a home.

Although inspections and the right to inspect by the buyer are in the contract, we don't have a formal period of time the buyer has to make inspections. Instead, we use an option period as the practical way to have an "inspection period". The option period in the contract reads as follows:

"TERMINATION OPTION: For nominal consideration, the receipt of which is hereby acknowledged by Seller, and Buyer's agreement to pay Seller $XXX (Option Fee) within 3 days after the Effective Date of this contract, Seller grants Buyer the unrestricted right to terminate this contract by giving notice of termination to Seller within XXX days after the Effective Date of this contract (Option Period)..."

Basically, the buyer can terminate for any reason during this period, so we want to make our inspections during this timeframe for the ease of terminating if we don't like something we find during our due diligence.
