Mr Mbonu, a prison officer at HMP Swaleside, represented himself in a nine-day Employment Tribunal.
The Tribunal upheld findings of:✔ Direct race discrimination✔ Harassment related to race✔ Constructive unfair dismissal
Examples of conduct examined by the Tribunal included:
• Officer Mark AcklandThe Tribunal found that he used an explicitly racist slur about Mr Mbonu (“lazy Black C-word”).The employer failed to properly address this.Police and CPS later confirmed there was sufficient evidence for a racially aggravated offence, but it was out of time to prosecute.
• Senior Officer Steven BlancheThe Tribunal accepted evidence that he referred to Mr Mbonu using abusive and racially derogatory language, contributing to a hostile work environment.
• Custodial Manager James RichardsonThe Tribunal found that he falsified records about Mr Mbonu, including falsely stating a sickness meeting had taken place.This misconduct was not investigated, while Mr Mbonu was subjected to disciplinary action.
• Senior management (including Governor Duncan Gow)The Tribunal found that complaints about racism were not adequately addressed, and that unequal treatment formed part of a course of conduct that destroyed trust and confidence.
The Tribunal rejected the argument that this was merely poor management.They found that race was a significant influence.
Liability was upheld.The case proceeded to remedy, but the compensation outcome was never made public.
