Are frozen embryos children? Fertility doctor explains Alabama Supreme Court impact

The Alabama Supreme Court recently ruled that frozen embryos could be considered children under state law.

In an 8-1 decision, the ruling used anti-abortion language, added to the Alabama Constitution in 2018, as justification. Alabama justices ruled from their 1872 state law that frozen embryos “applies to all unborn children, regardless of their location.”

This decision came from two wrongful death cases brought by three couples who had frozen embryos destroyed in an accident at a fertility clinic.
