How To Get Bail From Supreme Court
Comprehensive explanation on how to get bail from Supreme Court of India by Supreme Court lawyer Umesh Sharma, Advocate.
Bail can be filed by the Supreme Court of India against orders of High Court under Article 136 of the Constitution of India or directly under Article 32 by way of a writ petition.
Most of the cases pertain to filing of SLP , Criminal for grant of bail by Supreme Court. Bail from supreme court is filed against the orders of any high court when the application filed by the person before the High Court for grant of bail is rejected. Such petition before the supreme court is called SLP or special leave petition. By way of such petition, the applicant or the petitioner seeks the leave to appeal against the orders passed by the high court on several legal grounds. If someone is arrested or is apprehending arrest, he can file bail applicaiton before the Supreme Court and the court thereafter issues notice or seeks the status report in the matter if the same is accpeted by the court. If the court is not satisfied , then it can dismiss the said petition.
