There are some marked differences between the way arraignments are conducted in Atlanta Municipal Courts and other courts in the state. The purpose of an arraignment in Atlanta's Municipal Court is the same as other courts in Georgia: for the defense to enter a plea. The process, however, is structured in a different way. In fact, it may take three separate court dates before you enter your plea. The initial arraignment will be held the first Monday after your arrest. This time frame for scheduling an arraignment hearing may be shorter for municipal courts as opposed to other courts in Georgia. At the hearing, the judge will resend for about a month. When your next court date comes up approximately a month later, you have two options: you and/or your lawyer on your behalf may enter your plea and request either a jury or a bench trial; or, you may request a continuance to postpone the court date for yet another 30 days. Your attorney may advise the judge that the defense has not had a chance to review the police reports, for example, or that more time is needed. On that third court date, approximately 60 days after your initial arraignment hearing and arrest, a plea will be required. There are, of course, variances from case to case that necessitate requesting additional court dates. No matter when it happens, the end result will be the defendant's entered plea.
