A federal appeals court in Washington, D.C., denied former President Donald Trump's plea to review an order limiting what he can say about his criminal case with the 2020 election aftermath, setting up a future Supreme Court fight.

In a brief unsigned opinion published Tuesday, the justices of the United States Court of Appeals for the District of Columbia Circuit refused Trump's request to hear the disagreement over the gag order "en banc," or in front of the whole court. In December, a three-judge panel essentially upheld the gag order, allowing Trump to seek a full appeals court review.

Appeals Court Gives KNOCKOUT BLOW to Trump with Ruling
U.S. District Judge Tanya Chutkan, who is overseeing special counsel Jack Smith's case against Trump in Washington, issued an order in October at Smith's request prohibiting Trump from making inflammatory remarks about Smith, his staff, court personnel, and potential witnesses who could be called to testify in the case.
The three-judge bench affirmed the majority of Chutkan's order, stating that Trump cannot target possible witnesses or comment publicly about any lawyers involved in the case, except Smith himself, or their families. Trump, on the other hand, can continue to criticise the Biden administration and the Justice Department, alleging that Smith's case is politically motivated.
Tuesday's order dismissing Trump's appeal indicated that the decision was unanimous, with no judges demanding a vote on the issue. Trump's lawyers have previously stated that if the appeals court did not find in their favour, they would most likely take the case to the Supreme Court.
In the December order, the three judges — Patricia Millett, Cornelia Pillard, and Bradley Garcia — said they agreed with Chutkan that some aspects of Trump's public statements "pose a significant and imminent threat" to the integrity of the ongoing criminal prosecution, "requiring a speech-constraining protective order."
However, the judges ruled that Chutkan's decision "sweeps in more protected expression than is required" and overturned several of the limits, including those that banned Trump from publicly speaking about Smith.
Trump was accused on four counts for allegedly attempting to obstruct the transfer of presidential power following the 2020 election. He's pled not guilty and denies any misconduct.
The former president's legal team argued that any gag order violated Trump's right to free expression, particularly on the campaign trail, and tied his vociferous criticism of the special counsel's criminal prosecution to his quest to return to the White House. Smith's lawyers, on the other hand, claimed that some of Trump's public statements and social media posts compromised a fair trial and the safety of individuals involved.
