The Supreme Court observed that the detailed guidelines issued by it in Rajnesh v. Neha and Another, regarding the payment of maintenance in matrimonial matters are not being followed in many cases.

🟨 How much maintenance can a wife claim?
Various factors are considered by the Courts including the living standards of the husband and the rational needs of the wife. However, the Supreme Court, in a recent case, has ordered that 25% of the husband's net salary be paid as maintenance to his estranged wife.

🟨 A person may sue for maintenance under s. 125 of CrPC. If a person has already obtained maintenance order under his or her personal law, the magistrate while fixing the amount of maintenance may take that into consideration while fixing the quantum of maintenance under the Code.
