Welcome to another session in our Brown Bag Lunch Series. Professor Aaron Mills (McGill University) discusses "Treaties from an Indigenous Law Perspective".

The Canadian courts and the Canadian government both regard Canada's Treaties with Indigenous peoples as a special kind of contract. This zero-sum approach is adversarial: when one side gains, the other necessarily loses. On this view, treaty is thus anti-relational. It pits indigenous peoples and settlers against one another.

Does this view of Treaties reflect the way that Indigenous Elders talk about Treaty? My experience in our lodges and with our elders suggests, rather, that from the standpoint of Indigenous law, Treaties are understood as relationships. On this view, the central idea is for everyone to gain. In my discussion, I will offer my understanding of how this indigenous idea of Treaty works, from the standpoint of Anishinaabe law.

Aaron Mills' Bio:
An Anishinaabe from Couchiching First Nation in Treaty #3 Territory. Aaron works to renew Anishinaabe law, Anishinaabe constitutionalism, and treaty relationships today. Aaron has spent much of the last 15 years learning about Anishinaabe law in Anishinaabe communities, on the land, and from Anishinaabe knowledge-holders. Aaron joined McGill Law as an Assistant Professor in 2018 and is the Canada Research Chair in Indigenous Constitutionalism and Philosophy. As a community-engaged scholar, Aaron works with indigenous individuals, communities, and organizations on projects related to indigenous law and to treaty.
