Welcome from Chair, Mark Cullingford, Thrings
Seeking early advice when a Director identifies an issue which could affect the viability of the business enables the Board of Directors to consider a wider range of options.
Milsted Langdon’s Restructuring and Insolvency Team supports companies through times of crises, with an expert team specialising in delivering swift rescue, restructuring and insolvency advice.
Milsted Langdon will create a mock first meeting with a Director together with the Company’s Solicitor/Accountant which will demonstrate the type of information required in order to identify some options that the Director could take back to the Board for consideration and in-depth discussion. The main considerations could include:
When to call in the experts
Succession planning
Trading implications
Consideration of premises including rent/lease commitments
Secured borrowings/finance agreements
Options when already insolvent
Employee considerations
Dealing with assets
Key customer considerations
Contractual agreements
Implications for directors and personal guarantees
In the second part of the session, we will hear from Mark Beaumont of Annecto Legal Limited, brokers who specialise in After the Event insurance and Commercial Litigation funding that assists solicitors and Insolvency Practitioners in exploring various retainer options around both funding and de-risking their client’s claim. Such assistance not only allows solicitors to meet their professional obligations to clients but can often ensure that a solicitors cashflow is maintained rather than just growing WIP.
Annecto will cover various key areas such as duty to creditors and dealing with adverse costs risks.
