क्या सरकार की आलोचना करना अपराध है?
क्या एक पत्रकार का सवाल पूछना राजद्रोह माना जा सकता है?
हाल ही में सुप्रीम कोर्ट ने देशभर के पत्रकारों को राहत देते हुए साफ कहा है —
‘सरकार की आलोचना लोकतंत्र की आत्मा है, अपराध नहीं।’
जहाँ एक और पत्रकारों पर ताबड़तोड़ मुकदमे दर्ज हो रहें हैं वहीँ सुप्रीम कोर्ट से आई इस बड़ी खबर ने प्रेस की स्वतंत्रता पर छाए डर के बादल कुछ हद तक हटाए हैं।" Abhishek Upadhyay vs State of Uttar Pradesh & Others (2024) में फैसला सुनाते हुए सुप्रीम कोर्ट ने एक बड़ा महत्वपूर्ण फैसला दिया है, कोर्ट ने कहा सरकार की आलोचना करना अपराध नहीं है।

Is criticizing the government a crime?
Can a journalist's questioning be considered treason?
Recently, the Supreme Court, while providing relief to journalists across the country, clearly stated –
"Criticism of the government is the soul of democracy, not a crime."
While journalists are being sued at a rapid pace, this significant news from the Supreme Court has somewhat dispelled the fear looming over press freedom. While delivering the verdict in Abhishek Upadhyay vs. State of Uttar Pradesh & Others (2024), the Supreme Court has given a very important decision, stating that criticizing the government is not a crime.

अब आगे क्या
इस आदेश के बाद यूपी सरकार को चार हफ्ते में जवाब देना होगा,
और तब तक अभिषेक उपाध्याय को गिरफ्तारी से पूरी सुरक्षा दी गई है।
अगली सुनवाई नवंबर में होगी।
लेकिन असली बात यह है —
अब राज्य सरकारें किसी पत्रकार के खिलाफ एफआईआर दर्ज करने से पहले कानूनी और संवैधानिक आधार देखे बिना कार्रवाई नहीं कर सकतीं।
यानी, अब डर की दीवार थोड़ी हिली तो है लेकिन इसके अलावा भी कई और सेक्शंस हैं जिनमे पत्रकारों पर मुकदमे दर्ज किये जाते हैं।
एक रिपोर्ट के अनुसार,
2012 से 2022 के बीच देशभर में 423 पत्रकारों पर आपराधिक मामले दर्ज हुए।
CPJ (Committee to Protect Journalists) के मुताबिक,
भारत में आज भी कई पत्रकार मुकदमों और धमकियों का सामना कर रहे हैं।
लेकिन इस फैसले ने एक नया उदाहरण पेश किया है —कि कम से कम सुप्रीम कोर्ट में तो पत्रकारों की उम्मीद जिन्दा है| जो प्रेस की स्वतंत्रता की रखवाली कर रहा है।
ये फैसला सिर्फ अभिषेक उपाध्याय के लिए नहीं,
बल्कि हर उस रिपोर्टर, फ्रीलांसर और डिजिटल पत्रकार के लिए है
जो आज भी सच दिखाने के लिए लड़ रहा है।
क्योंकि जैसा सुप्रीम कोर्ट ने कहा —
“सरकार की आलोचना अपराध नहीं, लोकतंत्र की आत्मा है : सुप्रीम कोर्ट ।”
