People often think that there is no difference between a DUI and a DWI. Driving while under the influence, is deemed to be a lesser charge because you are just "under the influence" of alcohol. Driving while intoxicated means you are now "intoxicated," which is a higher level of impairment from a simple DUI. This is determined by whatever the alcohol level is.

In California we don’t have DWI, we only have DUI; California is considered a zero tolerance state, which basically means that if you are .08 or more then you are going to be charged with a DUI. In other words, California does not distinguish between various alcohol levels when determining the charges. However, California does have "enhancements" that may enhance the punishment, but the charge itself remains a DUI charge (VC23152).
