TRESPASS

Trespass is unlawfully entering or remaining on someone else’s property. Since this is such a broad offense, Colorado law has three different degrees of trespass.

First degree trespass is knowingly and unlawfully entering someone else’s home. It is a class 6 felony, carrying one year to 18 months in prison and/or fines of $1,000 to $100,000. First degree trespass also comprises entering someone’s car with the intent to commit a crime inside. This is a class 1 misdemeanor carrying up to 364 days in jail and/or up to $1,000 in fines.

Meanwhile, second degree trespass comprises knowingly and unlawfully entering or remaining in the common areas of a hotel, motel, condominium, or apartment building. This is a petty offense carrying up to 10 days in jail and/or up to $300 in fines. Second-degree trespass also comprises knowingly and unlawfully entering or remaining in another person’s car without an intent to commit a crime inside. This is a class 2 misdemeanor, carrying up to 120 days in jail and/or up to $750 in fines.
Finally, most other types of trespass are prosecuted as third-degree trespass. This is usually a petty offense carrying up to 10 days in jail and/or up to $300 in fines.
