It turns out that regardless of your music setting, the discussion Brom has with you at the start of the game will force the Oakvale theme to be played.

I am assuming this is because that sound file is temporarily a Sound Effect or Dialogue while that cut scene is played, because the only way to get rid of it is to turn down all three audio settings.
