Bayana or the token money is the advance amount paid by the buyer to enter into a sale agreement with the seller. This is also known as the bayana agreement. When a person is planning to buy a property, several steps are involved in registering property. 
Once the buyer likes a particular property and decides to buy it, a deal is signed between the buyer and seller. A sale agreement or agreement of sale is one of the steps involved in registering property. This sale agreement is sealed with the payment of Bayana or the token money by the buyer.  
Is Bayana Refundable? 

Whether the bayana paid on the property is refundable or not depends on case to case basis. Therefore to understand if the bayana will be refundable or not, three different cases have been discussed below. 

Bayana Refund Case 1: 

The buyer pays an advance amount or the token money to the seller to obtain the property documents and verify them. Some sellers give a month or 15 day timeframe to cross-verify the property documents. If the buyer is not interested in going ahead with the property purchase, he or she must return the documents within the given time. If the documents are returned within the given time, the seller will return the token amount or bayana to the buyer.
Bayana Refund Case 2:

Once the cross verifying of the property documents is complete, the buyer and seller enter into a sale agreement or bayana agreement. The time frame by which the registration should be completed is mentioned in the bayana agreement. If the seller has given a time of 3 or 6 months to complete the registration process, and if the buyer fails to arrange the deal amount within that time frame and backs out from the deal, then the seller will not return the token money or bayana to the buyer.
