Section 18 BNSS – Public Prosecutors

Section 18 of the Bharatiya Nagarik Suraksha Sanhita, 2023, deals with the appointment, eligibility, roles, and responsibilities of Public Prosecutors, Additional Public Prosecutors, and Special Public Prosecutors in both High Courts and District Courts. Key points:

1. Public Prosecutors are appointed by the Central or State Government with consultation from the respective courts.

2. A panel of eligible advocates with at least 7 years’ experience (10 years for Special Public Prosecutors) is prepared for appointments.

3. The section ensures fair presentation of criminal cases by qualified legal officers on behalf of the government.

4. Courts can also allow victims to hire their own advocate to assist the prosecution in certain cases.

Section 20 BNSS – Directorate of Prosecution

Section 20 introduces the concept of a Directorate of Prosecution for each state. Key features:

State Governments may establish a Directorate of Prosecution consisting of a Director and additional staff.

This Directorate is tasked with administering, supervising, and streamlining the process of prosecuting criminal cases in the state.

The structure aims to professionalize, strengthen, and coordinate prosecution services at all levels.
