Nintendo is banning some Switch 2 consoles, leading to accusations of wrongful bans, especially when users buying secondhand units or legitimate old games get caught in the anti-piracy net, raising consumer rights concerns, particularly highlighted by a challenge from Brazil's Procon-SP agency. Many of these bans stem from the use of cloned games, often via devices like MIG carts, triggering Error Code 2124-4508, though some users claim innocence, prompting debates over the fairness and transparency of Nintendo's actions and EULA.

Why Consoles Are Being Banned:
Piracy/Modding: Nintendo's End User License Agreement (EULA) allows them to disable consoles for piracy, running unauthorized software, or tampering with system protections.

Cloned Games: A major issue involves second-hand Switch 1 game cartridges that were illegally copied onto flash carts (like MIG carts) and sold, leading to innocent buyers having their Switch 2 banned when playing them.

"Bricking": Bans can "brick" the console, restricting access to the eShop, online services, and cloud saves, effectively making it unusable.

Accusations of "Wrongful" Bans:

Second-Hand Market: Users buying used consoles or games on platforms like eBay have found them already banned, despite no fault of their own.
Lack of Transparency: Bans often come with generic error messages (like Error Code 2124-4508) without clear explanation, frustrating users.
Consumer Rights Issues: Brazil's consumer protection agency, Procon-SP, has officially challenged Nintendo's right to permanently disable hardware, calling the practice abusive under Brazilian law.

Nintendo's Stance & User Recourse:
Nintendo reserves the right to disable devices for EULA violations, as outlined in their terms.
