From the NH State Senate public hearing for HB177, discussion relative to permitting and siting landfills in NH, landfill capacity, and NH State Senate Energy and Natural Resources Committee Chairman, Senator Kevin Avard's shock, to learn that nearly 50% of what is landfilled in NH is from out of state (and he's the Chair of the Senate E&NR Committee?). You'll also see him accidently express some sublime concern over the impact of NCES closing, and GSL not being permitted.

Director Mike Wimsatt mentions 3 criteria that MUST BE MET in order to meet the "substantial public benefit" criteria, as per RSA 149-M, in order to be permitted:

1. The short and long-term need of the facility to provide capacity to accommodate solid waste generated in NH

2. The ability of the facility to assist the state in achieving the implementation of the hierarchy and goals in statute and any solid waste plans submitted by solid waste districts

3. The ability of the facility to assist the state in meeting the goals of the state solid waste plan.

Director Wimsatt also discusses the 3 "unlimited service area" landfills, Turnkey, Mt Carberry, and NCES. He mentions that Turnkey's permit does expire in 2034, but he believes there will be an expansion permit forthcoming in the future.

Senator Avard also refers to the earlier testimony of State Rep. Tim Egan in his statement that NH tourism is a $5.5 Billion industry in the state, and slips a bit in discussion, seemingly alluding to the threat posed by Casella's GSL landfill project next to Forest Lake State Park in Dalton, NH.

Casella attorney Brian Ghoul also provides misleading testimony, which is debunked by Director Wimsatt, in an attempt to convey the false perception that there is a "capacity crisis" in NH, especially should NCES close and GSL not be permitted, due to the passage of HB177. Director Wimsatt shares in his testimony that they only look at a 20-year window in permitting landfill capacity. Of course, fast forward to November, 2022, and the newly-release 2020-2021 Biennial Solid Waste Report also debunks the false narrative advanced by Mr Ghoul and his client, Casella. There is no capacity "shortfall" until 2034, as a result of the expansion permit approval of the Mt Carberry Landfill.

This public hearing will serve to confirm that Casella has tried to advance a false, misleading narrative that there is a capacity crisis in NH, and Director Wimsatt's testimony underscores the fact that there is no substantial public benefit to NH for a new landfill next to Forest Lake, due to there not being a capacity shortfall for NH waste until at least 2034, and most likely beyond that, due to Turnkey's eventual expansion approval before then.
