The Supreme Court of India has laid down several guidelines for arrests, including:
Identification
Police officers must wear clear identification and name tags with their designations.
Memo of arrest
The arresting officer must prepare a memo of arrest at the time of the arrest, which should be witnessed by a family member or local resident.
Informing the arrestee
The arrestee must be informed of their rights, including the right to be informed about the grounds of arrest in writing.
Informing a friend or relative
The arrestee's friend or relative should be informed as soon as possible that the arrestee has been arrested.
Medical examination
If the arrestee is injured, they must be examined by a medical professional within 48 hours.
Meeting with a lawyer
The arrestee should be allowed to meet with their lawyer during interrogation.
Handcuffs
Handcuffs can be used for habitual offenders, repeat offenders, or those committing specific offenses.
Reasonable investigation
An arrest should not be made without a reasonable investigation to support the complaint and the belief that the person is involved.
