During the stop, police discovered marijuana and a firearm hidden under the seat. As a convicted felon, Garcia was legally prohibited from possessing a firearm. Throughout the hearing, the judge carefully reviewed his extensive criminal history, which included multiple drug-related offenses, revoked probations, and prior prison sentences. The judge expressed concern over Garcia’s inconsistent statements, emphasizing that credibility plays a major role in sentencing decisions. Despite serious concerns, the court offered Garcia a choice between three years in prison or strict probation with treatment requirements. Garcia chose probation. The judge sentenced him to six years suspended and eight years of probation, along with drug court referral, substance abuse treatment, random drug testing, employment verification, parenting classes, and a strict ban on drugs, alcohol, and firearms.
The judge made it clear that probation is a second chance, not a guarantee, and warned that any violation could result in immediate imprisonment.
