The Pentagon is reviewing Sen. Mark Kelly over a video urging U.S. troops to defy what he calls illegal orders.

A criminal defense attorney discussed the possibility of the senator being recalled to service. But can someone at the Pentagon do that?

"Absolutely. Yup. Now the question is - it's unprecedented - I looked this up. There's only been one other time in U.S. history, 250 years, where a sitting member of Congress was court-martialed, and it was during the Civil War. It was a Congressperson from Ohio. He was court-martialed because his loyalty was questioned that he was supporting the confederacy," said attorney Joshua Kolsrud on FOX 10 Talks.
