have you ever wondered how a defense attorney views and interprets things like murder homicide manslaughter it's terms that we hear all the time but not so many people really understand what they mean my firm since 2010 has been handling murder homicide vehicular manslaughter all those types of cases at a high level in this video we're going to talk about the different types of murder we're going to talk about manslaughter we're going to talk about vehicular manslaughter and we're going to talk about first and second degree murder we're going to talk about the differences in elements of what the prosecution needs to prove what they have to prove and what they don't we're going to talk about possible penalties if you were loved one or convicted of these types of homicide offenses we're also going to talk about defenses how a defense for murder may not be a defense to manslaughter and vice versa and we're also going to talk about a lot of common mistakes people make along the way when they're investigated or when they're charged with a homicide offense we're going to talk about something known as a Perkins operation or a jail house informant operation something that a lot of times is really the nail in the coffin that will get you or your loved one convicted of a homicide when otherwise they might beat the case we're going to tie this all together in this video to understand what you need to know to protect your freedom to protect your future you have to know your rights a key legal consideration in any homicide cases what is actually a homicide so many times in real life and actually even on TV they get it right when you see a medical examiner on the witness stand and a prosecutor asks this dramatic question what was the manner of death like people don't know and it's this big dramatic pause that a medical examiner says homicide well what is a homicide a homicide is an unlawful killing of another but under that umbrella of homicide there are different lay ERS to it there's murder and there's manslaughter the biggest difference between murder and manslaughter is murder is done with malice generally speaking with either the intent to kill or with such Reckless indifference to human life manslaughter you don't necessarily need the intent to kill manslaughter could be things like imperfect self-defense you had a right to defend yourself but you took it too far you may be guilty of manslaughter but not of murder or it could just be a gross negligence type of situation you see Manslaughter a lot when you're dealing with DUIs and someone's killed maybe it's gross vehicular manslaughter or gross vehicular manslaughter while intoxicated these differences may seem minute and legal to you but they make a big difference when we're talking about the penalties and what if anything you or a loved one will be convicted of if you find yourself charged with the homicide now I want to talk to you about the differences between first degree and second degree murder in California first degree murder is done with premeditation or deliberation well what does that mean a lot of times people think that well you know it has to be this big elaborate plan right it has to be like a lifetime movie type situation not at all it could be seconds of planning it could be you see someone walking down the street and you're like hey I'm going to kill this person that is enough in California second degree murder a lot of times doesn't require deliberation or premeditation what it requires what you see sometimes is it's a fight someone ultimately loses their life you could be charged with second degree murder under certain situations you could have another situation where you know it's a DUI it's a Watson murder situation you're charged with a DUI you may have a prior DUI there's an accident someone's killed Reckless indifference to human life you see that charging California as second degree murder well what's the real difference between first and second degree murder what really matters to you or your loved one if you're facing these charges well that's a penalty if you're convicted if you're convicted of first-degree murder at a minimum you're doing 25 years of life in prison that's assuming no weapon was involved you used a knife you're doing 26 to life in prison used a firearm you doing 50 to life in prison if not more second degree ...truncated...
