A Bivens claim, much like a Section 1983 lawsuit, is the civil cause of action to seek monetary awards from a lawsuit alleging civil rights violations by government agencies and employees. The difference between a Section 1983 lawsuit and a Bivens claim, is that a Section 1983 lawsuit protects against civil rights violations by local and state officials, such as local law enforcement, whereas a Bivens claim protects citizens from abuse by federal agents and government officials at the national level, such as the FBI or a congressperson.
Bivens claims can seek financial compensation due to the malevolent actions of federal police officers, FBI agents, DEA agents, guards at federal prisons, members of congress, and many other federal employees. But most often Bivens claims occur because of the actions of federal police officers. Some of the specific civil rights violations that are most often alleged against these officers are: excessive force, racial profiling and discrimination, unlawful detention, and false arrest.
