Right to Property was a Fundamental Right in the Indian Constitution. Later through 44th Constitutional Amendment in 1978, it was a Constitutional Right only through Article 300 A.

Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 passed by Central Government is the latest law with regard to acquisition of Land for Infrastructure Development.

There was specific laws like National High Way Act, Railway Act etc. with regard to acquisition of Land for specific purposes.

The question raised before the Kerala High Court was that the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was invalid in acquiring Land for K Rail or Silver line Project. The contention was that, since the said Project was a Railway Project, The Railway Act was the correct law applicable. But the Kerala High Court rejected the contention.

The Kerala High Court said that as the K Rail Project or Silver Line Project was for Infrastructure Development, Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 is applicable and the act of Kerala Government is correct.
