I've spent more than 33 years as the owner of an HOA property management company and over 22 years practicing homeowner association and real estate law.
The Davis-Stirling Act, which is the main body of law in California that applies to common interest developments, requires homeowner associations to adopt election rules. This has been the law since July 1, 2006. Most management companies are aware of this requirement. The Davis-Stirling Act states that election rules must incorporate the relevant language from the association's bylaws and CC&Rs. Election rules are adopted like any other HOA operating rules, and should include the following:
1. Nomination procedures,
2. The qualifications required of directors,
3. The method of selecting the inspector or inspectors of election,
4. Any rules for accessing association media or common areas,
5. A description of the secret balloting and mailing procedures,
6. The procedures for contested elections, and
7. The procedures for recall elections.
