The Supreme Court has intervened in the escalating face-off between the Enforcement Directorate (ED) and the Mamata Banerjee-led West Bengal government, pausing FIRs registered by the Kolkata Police against ED officers in connection with searches at premises linked to political consultancy I-PAC.

A Bench of Justice Prashant Mishra and Justice Vipul Pancholi sought responses from the Ministry of Home Affairs, the Department of Personnel & Training, Chief Minister Mamata Banerjee, and the Trinamool Congress government on the ED’s plea seeking suspension of West Bengal DGP Rajeev Kumar, Kolkata Police Commissioner Manoj Kumar Verma, and other officials. The Court has also sought replies on the demand for a CBI probe into the alleged obstruction of the ED’s investigation.

Observing that the case raises “serious issues” concerning interference by state agencies, the Supreme Court warned that failure to address such questions could lead to “lawlessness.” The Bench questioned whether central agencies probing serious offences can be obstructed by political or state actions if they are acting bona fide.

The hearing follows chaotic scenes in the Calcutta High Court during related proceedings, which the Supreme Court said it was “very much disturbed” by. Solicitor General Tushar Mehta, appearing for the ED, accused the Bengal government of interference, termed the situation “mobocracy,” and demanded suspension of top police officials.

Senior Advocates Kapil Sibal and Abhishek Singhvi, appearing for Mamata Banerjee and the Bengal government, questioned the timing of the ED searches ahead of Assembly elections and defended the state’s actions.

The matter will be heard next on February 3.
