The Guam Education Board voted to terminate superintendent Jon Fernandez's contract as the head of the Guam Department of Education. The decision by the Guam Education Board came after nearly five hours in executive session.

The board voted 6 to 3 in favor of terminating the contract based on a "preponderance of evidence" contained in the 68 page internal investigation report into the sexual misconduct allegation against Fernandez. The members who voted to terminate the contract include Ken Chargualaf, Ryan Torres, Rosie Tainatango, Dr. Jose Cruz, Charlene Concepcion, and chairwoman Lou San Nicolas.
Those who voted against the vote include board members Maria Gutierrez, Lou Benavente, and Peter Alecxis Ada.

Legal counsel Gary Gumataotao clarified that this decision does not mean Fernandez is fired. He said additional steps must be taken to fire a Superintendent of Education. He also said that the information contained in the report would remain sealed for at least six months.

At that point he said he will likely request to keep the report permanently sealed because it contains information that could be adverse to the Government of Guam. The board will likely schedule another meeting to address the issue of Fernandez's administrative leave, which ends Tuesday, because it was not addressed at Monday's meeting.
