The Bombay High Court said Aadhaar, PAN card, and voter ID card alone cannot make a person an Indian citizen.
Why did the Bombay court say this ? Let me explain.
A man named Babu Abdul Roop Sardar is from Bangladesh.
He entered India illegally.
He got an Aadhaar card, PAN card, voter ID, and Indian passport using fake documents.
He stayed in India for more than 10 years with these fake papers.
He has been arrested.
Police concern, the police told the court his documents are still under investigation.
If he gets bail, he might escape.
The court agreed and rejected his bail request.
The court said, always follow the Citizenship Act, 1955.
It explains who can be an Indian citizen, how to get citizenship, and how it can be lost.
Having Aadhaar, PAN, or voter ID is only for identity or services, not proof of citizenship.
According to the Citizenship Act, 1955 and the Constitution of India, the Indian citizenship was decided by his birth.
For example : if you were born in India before 1 July 1987, automatically an Indian citizen.
Born in India between 1 July 1987 to 3 December 2004 you are a citizen if at least one parent was an Indian citizen at the time of birth.
Born in India on or after 3 December 2004, if both parents are citizens no problem.
OR one parent is a citizen and the other should not be an illegal immigrant.
Foreigners who have lived in India for 12 years (and meet other requirements) can apply for citizenship.
