Can a REAL ESTATE AGENT represent buyer and seller on the same transaction? As a Buyer, should you use the listing agent when buying a home or should you have your own Realtor? This is called a dual agency and we discuss it in more detail in this video.

Can a Realtor represent Buyer and Seller?

Yes, the State of California allows Dual Agency which is where the same Broker that represents the listing can also represent the buyer on the same transaction. In some states this is not allowed but California does allow the a realtor to represent both buyer and Seller.

Keep in mind that in the case of dual agency the agent that is supposed to represent both parties equally and not favor one over the other. This can be a very grey area in real estate because your job is to not only get the highest price for your seller but also get the best deal for your buyer.

Should I use the listing agent when buying a house?

Even though Dual Agency is allowed, I think it's better if the buyer has a different Realtor than the Seller in order to get represented to the best of their ability. Keep in mind that as a Realtor who represents Listings quite often, representing both the buyer and seller would in most cases double my commission. But I'm telling you as a rule of thumb, in most cases you would want your own Real Estate Agent. I know this is NOT the typical advice you would hear but most Realtors out there don't have the wherewithal to represent both parties in the best capacity.

There are professional Realtors out there like myself who can represent both parties correctly but in most cases, I see it done incorrectly and that's the reason I would suggest having your own representation when buying a home.
