Описание к видео Types Of Bail | Right Of Temporary Release | India Legal| India Legal

In India, bail refers to the temporary release of an accused person from custody until their trial is complete. There are various types of bail available under Indian law, including common bail, anticipatory bail, interim bail, and default bail.

Common bail, also known as regular bail, is granted to an accused person who is in police custody or judicial custody, pending investigation or trial. The accused person can apply for common bail and the court can grant it based on the merits of the case, such as the nature of the crime, evidence available, and the accused person's criminal history. Common bail can be granted with or without surety, meaning that the accused person may or may not have to provide a financial guarantee to ensure their appearance in court.

Default bail is granted when the accused person is not brought before the court within a specified period of time, usually 60 or 90 days, depending on the nature of the offense. If the accused person has been in custody for the entire period and no charge sheet has been filed by the prosecution, then the accused person is entitled to default bail as a matter of right.

Anticipatory bail is granted to a person who apprehends arrest by the police in connection with a non-bailable offense. The court can grant anticipatory bail if it is satisfied that the person is not likely to abscond or tamper with evidence, and that there are no reasonable grounds for believing that their arrest is necessary to prevent them from committing an offense.

Interim bail is granted for a short period of time, usually until the next hearing, to allow the accused person to attend to urgent matters, such as medical treatment or attending a family function.
