Police stop a vehicle for an improper lane change, but the situation quickly escalates when passenger Tobian becomes defiant. She insists she isn’t the driver or intoxicated and only wants to go home. Her erratic behavior, disrespectful remarks, and refusal to cooperate raise further suspicion.

Despite repeated warnings, Tobian refuses both field sobriety and breath tests, claiming she doesn’t trust the officers. Her resistance turns violent when she bites an officer during the struggle. She is arrested and charged with DUI, battery, and resisting arrest without violence — and is later convicted on all counts.
