Domestic violence cases raise urgent safety concerns in divorce, and for many lawyers, that can make “out-of-court” options feel off-limits. In this course, Jacqueline Caputo of Joseph Law Group, P.C. and Elizabeth Vaz of VazLaw explain how the collaborative divorce model can be structured to prioritize protection, informed consent, and stability, while reducing the chaos and retraumatization that often comes with adversarial litigation. They introduce collaborative divorce as a team-based process designed to help families reorganize thoughtfully, not “win,” and they address why this approach can be especially meaningful when power imbalances are present.

Caputo and Vaz explore how attorneys can assess whether collaborative is appropriate, including screening for coercive control, building safety plans, and using safeguards like separate rooms or virtual participation, staggered arrivals, temporary agreements, and ongoing monitoring throughout the matter. They also discuss ethical boundaries and the moments when professionals must end the process, along with the critical role of mental health and financial neutrals in supporting communication, transparency, and client autonomy.
